Housing Benefit
Hi I wondered if somebody would be able to give some advise on this.
Curently living in a house where my name is on the contract and the
bills are split between my housemate and myself 50/50.
Housemate is now unemployed and going through the process of trying to
claim for housing benefit.
Even through the housemate name is not on the contract, but on a
confirmation letter that the landlord has sent for the purpose of
claiming housing benefit. Housemate name is on other bills for example
Gas/Electricity and is on the electoral role for the property. JSA is
already being paid.
Council representative that has been spoken to does not see any
problem with claiming,
Would the claim be successful?

To claim HB you must provide proof of paying rent to a LL, HA or council,
and have a tennancy agreement.
So you need a rent book, on sale in WHSmiths or Staples, and a copy of a
tennancy agreement drawn up on a sheet of A4 paper, add a couple of rules
like no firearms or bomb making paraphernalia allowed in the property, no
pets except for tall leggy blonds, and do not sell the house without the
owners permission etc.

Who actuallu has a rent book, when you pay by direct debit/standing
order you do not get one.

Top posting / snipping / terrorists aside the letter from the landlord
that confirms the arrangement should be perfectly fine.
The only requirement is that there is a legal liabilty to pay rent and
that the tenancy is on a commercial basis.
The letter from the landlord should cover this so long as it is
written reasonably well.
The eligible rent will be split 50/50 and so your housemate will be
able to claim their 50% as their rent.
"Eligible" rent means the amount paid for the accommodation and for
any non-optional service charges. There might need to be some
clarification of what (if any) service charges there are. Your house
mate will also be able to claim for 50% of the Council Tax.

What 50%? if you are out of work, you dont pay CT.

but from the sounds of it, the named tennant is in work, so he has to pay
for his half of the rent and council tax.

The owner of the property is liable to pay CT if it is multiple occupancy,
ie if both tennants pay rent seperately. Couples living together share the
CT bill.

Course U bleedin do.
You claim CTax Benefit and if you are JSA(IB) you get your liability
paid in full.
Or am I missing something?
