Whereas it seems to me that the degree of danger to third parties posed
by various types of conveyance is what we're concerned with and why we
wish to regulate them (yes?), and that this is essentially independent of
whether they're deemed to be toys or not.  

You should also note that mechanically propelled toys such as go-karts
and mini-moto bikes are treated as motor vehicles by the law (requiring
registration, insurance, etc) despite the fact that they are obviously
playthings that not designed and intended for use on public roads.  So the
toy/non-toy distinction is not considered relevant there either
