IANAL
It may also depend on whether the PC has been powered up, which may
alter the initial "factory fresh" state, i.e. if it has Vista, it may
have forced some sort of EULA to be agreed to before it booted up.
The software licence agreement is typically tied to that specific
hardware, which might make it harder to say you do not want it, having
agreed to something intrinsically tied to it.
